PREAMBLE:
This Code of Ethical Conduct has been adopted to engender and instill the highest ethical standards in all persons engaged in the Holiday Timeshare Industry in Fiji.
The Code is phrased in simple and unambiguous terms and is to be observed and practiced - in the spirit as well as in the letter - by all members of the Association and their advertising, marketing, sales and management staff.
The Code is adopted for the benefit of both the consumers and the member to ensure that all aspects of the Timesharing Industry will be conducted on an high ethical plane, trusted and respected by all.
Each member of the Association is required to observe and abide by this Code of Ethics and unawareness of the Code shall be no excuse for it's non-observance by any member, or anyone acting for the benefit of any member.
The word "Association" means the Fiji Timeshare Association.
MEMBERS SHALL:
- Support the Association, comply with its Constitution, its Rules and Regulations, and uphold its prestige and reputation within the community.
- Act at all times in a professional manner to build a reputation for fairness and respect to enhance the public image of the industry.
- Observe and abide by the Code of Ethics and all legislation, regulations and guidelines that govern their activities
- Adopt responsible and generally acceptable trade practices
- Act with due skill, care and diligence in the performance of their duties.
- Strive to maintain and improve their professional knowledge, skills and competence.
- Act honestly, fairly, courteously and efficiently in all dealings with the public and with other members, and in particular shall:
- Protect the public against misrepresentation and unethical practices in Holiday Timeshare transactions:
- Give proper professional service to all prospective purchasers and owners:
- Explain thoroughly all terms and contracts to prospective buyers, always placing education and buyer understanding before the sale:
- Refund to any purchaser who wishes to cancel a contract within five working days of making a purchase, all monies received.
- Present a high quality of advertising which shows a true picture of Timeshare in all representations to the public:
- So conduct business as to minimize any discord or disunity with other members:
- If a dispute eventuates between members, submit such dispute to the committee of the Association for conciliation before any legal or other action is commenced: and
- At all times be fully responsible for the actions of their employees and for all other persons acting for their benefit.
MEMBERS SHALL NOT:
- Attempt to upset or negate an arrangement already entered into by another member with a consumer.
- Publicly criticize another member or that member's business.
- Publish any advertising or other information which is misleading or confusing to the public.
Conduct or allow any unseemly touting in a public place.
- Breach in the spirit, apart from in the letter, the principles, objects or ethics of the Association.
- Convey false, untrue, deceptive or misleading information nor make material omissions, through advertisements, statements, photographs, sales information, documents or other means which would be likely to affect consumer decision-making.
- Exert undue influence, pressure or persuasion on potential purchasers of Timeshare products to the detriment of the public perception of the industry.
- Use the fact of membership in a misleading manner.
